1. Who you are contracting with
The CM Marine Part A exam preparation service (the "Service") is provided by CM Marine Limited, trading as CM Marine ("we", "us"). By creating an account or using the Service you enter into an agreement with CM Marine Limited on these terms. Contact: hello@cm-marine.uk.
2. Acceptance
By registering for, accessing or continuing to use the Service you confirm that you accept these terms. If you do not accept them, do not use the Service. You confirm you are at least 18 years old or, where using the Service on behalf of an organisation, that you have authority to bind it.
3. The Service
The Service provides practice questions, mock examinations and progress tracking to help candidates prepare for MCA Part A theory examinations. It is a study aid produced independently by CM Marine Limited. It is not provided, endorsed or approved by the Maritime and Coastguard Agency, and we do not guarantee any examination outcome. Always rely on official MCA publications and your training provider for authoritative guidance.
4. Your account
You must provide accurate registration information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Accounts are for a single named individual and may not be shared.
5. Acceptable use
You must not:
- use the Service unlawfully or for any fraudulent purpose, or send spam through it;
- infringe our intellectual property or that of any third party;
- interfere with the security or integrity of the Service, including introducing malware, probing or scanning it, bypassing access controls, or scraping content by automated means;
- copy, republish, resell or redistribute questions, answers or explanations;
- reverse engineer the Service or circumvent technical or plan limits.
6. Intellectual property and licence
CM Marine Limited owns or licenses all intellectual property in the Service, including the question bank, explanations, software, design and branding. Subject to these terms we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your own personal exam preparation for the duration of your subscription.
7. Payment and subscription terms
Subscriptions are offered on a monthly or 6-monthly basis, with a free trial where advertised. Unless cancelled before the end of the current period, subscriptions renew automatically at the then current price. Payment, billing, currency, taxes, cancellation and refund mechanics are handled by our reseller under the Paddle Buyer Terms. Our own refund terms are set out in our Refund Policy. You can cancel at any time and keep access until the end of the paid period.
8. Reseller / Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
9. Availability and warranties
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation; it may be unavailable for maintenance, updates or matters beyond our control. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
10. Suspension and termination
We may suspend or terminate access where there is a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may close your account at any time. On termination your right to use the Service ends; you may request an export of your progress data within 30 days, after which data is handled as described in our Privacy Notice.
11. Liability
We are not liable for indirect, consequential or special loss, including loss of profits, data, goodwill or examination opportunity. Our total aggregate liability arising out of or in connection with the Service is limited to the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
12. Indemnity
You will indemnify us against claims and costs arising from your unlawful use of the Service, your breach of these terms, or content you submit through the Service.
13. General
We may update these terms; material changes will be notified before they take effect. You may not assign your rights without our consent; we may assign ours in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
